Terms of Service

The short version
- pushup.cc is for people in the United States, Canada (except Quebec), Australia and New Zealand, for now. Anyone there who is 13 or older can sign up. New accounts start in the lobby with the whole app; global leaderboards show members only.
- Log only reps you actually did. The leaderboards run on the honor system.
- Your reps and profile are yours. You let us show them to other users so the boards work.
- Clubs are free as a draft. Publishing a club is a subscription that renews automatically until you cancel, and you can cancel online anytime.
- pushup.cc is a tracker, not medical advice. Exercise at your own risk.
The agreement
These terms are an agreement between you and Nova Hawk Labs LLC, a Texas series limited liability company, at 1122 Colorado Street, Apt 1410, Austin, TX 78701, USA ("we", "us"), which runs pushup.cc. They cover the pushup.cc website and app. You accept them when you create an account. If you do not agree, do not use pushup.cc.
Our Privacy Policy and Health Data Privacy Policy explain how we handle your information. Our Community Guidelines and Copyright and DMCA Policy are part of these terms.
Who can use pushup.cc
pushup.cc is for people in the United States, Canada (except the province of Quebec), Australia and New Zealand, for now. New accounts are open only there. If you made an account from somewhere else before this, it keeps working. Club subscriptions need a billing address in the United States (see Club subscriptions). We may open more places later.
- 13 or older: you must be at least 13, and you confirm this when you sign up. If you are under 18, you need permission from a parent or guardian where your local law requires it.
- One person, one account: accounts are for a single person. Do not share, sell or transfer your account, and do not run more than one.
- Accurate details: use an email address you control so we can reach you. Keep your sign-in details secure and tell us if you think someone else has used your account.
- Where it is allowed: do not sign up from outside the United States, Canada, Australia and New Zealand, or from Quebec, and do not use pushup.cc if the law where you are forbids it.
Parents and guardians: parental control tools (device settings, software and filtering services) are sold or offered by many companies and can help limit what a child sees online. The US Federal Trade Commission explains how to use the ones from Apple, Google and Microsoft in How To Use Parental Controls.
The lobby and membership
Anyone 13 or older can create an account. New accounts start in the lobby, where you can use the whole app: log sets, add friends, join clubs and play games. Global leaderboards show members only. You become a member when an existing member vouches for you, when you join through a member's invite, or when our admins approve you. We decide who becomes a member and may move an account back to the lobby to protect the global boards.
Honor system and fair play
Every rep on pushup.cc is self-reported, so the boards only work if people are honest. Log only reps you actually did, as close to when you did them as you can. Our Community Guidelines explain what counts as a fake rep and what happens if someone logs them.
Acceptable use
You agree not to:
- log reps you did not do, or use scripts, bots or bulk entries to inflate your numbers;
- harass, threaten, or abuse anyone, or post hateful, sexual, violent or otherwise offensive names, photos, club names or logos;
- impersonate a person, brand or organization, or suggest an endorsement that does not exist;
- upload content you do not have the right to use;
- collect other users’ information, or scrape, crawl or copy the service by automated means;
- probe, scan or test our systems for weaknesses, except under our vulnerability disclosure rules in the Privacy Policy;
- interfere with or overload the service, or get around any limit, block or security measure;
- reverse engineer the app except where the law allows it; or
- use pushup.cc for anything illegal.
Your content
- You own it: your sets, stats, names, photos, club names and logos stay yours.
- You give us a license to run the service: you grant us a worldwide, non-exclusive, royalty-free license to store, copy, display, resize and format your content, and to show it to other users as the app works (on leaderboards, the feed, friends, clubs, games and public club pages). Our service providers may do the same on our behalf, only to run pushup.cc. This license ends when you delete the content or your account, except for copies in backups until they roll off and anything the law requires us to keep.
- You are responsible for it: make sure you have the right to post what you post, and that it follows these terms and the Community Guidelines.
- Our stuff: the pushup.cc name, logo, design and software belong to us. These terms do not give you any right to use them beyond using the app.
- Feedback: if you send us ideas or suggestions, we can use them without owing you anything.
Reports, moderation and appeals
You can report a user or content that breaks these terms in the app, or by emailing support@pushup.cc. A person on our team reviews every report. We do not tell the reported person who reported them.
If someone breaks these terms or the Community Guidelines, we may, depending on how serious it is: warn them; edit or remove a name, photo, logo or set; reset or remove stats; hide them from leaderboards; move them back to the lobby; suspend or close their account; or suspend or remove a club. We may act without warning when we need to protect people or the service.
When we take action against your account or content, we will tell you what we did, why, and which rule it was under, unless the law or someone's safety prevents it. You can appeal by replying to that message or emailing support@pushup.cc within 6 months. A person will review your appeal and tell you the outcome. Depending on where you live, the law may give you other ways to challenge a decision.
Clubs
A club is a branded workspace with its own leaderboard. Anyone with an account can create one.
- Roles: every club has one owner and may have admins and members. The owner controls the club and its billing. Owners and admins manage members, invites and join requests.
- What club owners and admins can see: members’ names, photos and club leaderboard standings, and the name and email address of anyone who asks to join the club. They cannot see your height, weight, daily goal numbers, or your email address unless you send them a join request.
- Public club pages: each published club has a public page at pushup.cc/clubs/ followed by the club’s address, showing anyone its name, logo, colors, description, member count and how to join. It does not show the club’s members or leaderboard to signed-out visitors. Draft, suspended and removed clubs have no public page.
- Owner responsibilities: owners are responsible for their club’s name, logo, colors and invite links, and for any email domain restriction they set. Club names and logos must not infringe anyone’s rights or impersonate a real organization.
- Leaving and removing: members can leave a club at any time. Owners and admins can remove members. Our rules apply inside clubs too, and we can suspend or remove a club that breaks them.
- Deleting your account: if you own a club that has other members, you must hand ownership to someone else before you can delete your account. A club you own alone is deleted with your account, and its subscription is canceled.
Club subscriptions
Personal accounts are free. A club is free to build and use as a draft. Publishing a club unlocks bringing people in (invite links, invite emails and approving join requests), and requires a paid subscription. This section applies to the club owner who subscribes.
Club subscriptions are available only in the United States for now, and need a billing address in the United States. If a checkout has a billing address outside the United States, we cancel the subscription right away, do not publish the club, refund anything charged in full, and email you.
Price and plans
Subscriptions are billed monthly or yearly, per club. The price, the billing interval, any free trial, and the date of your first charge are shown on the Publish screen and on the Stripe checkout page before you pay. Any taxes are shown at checkout. Payments are processed by Stripe, and Stripe's terms also apply to your payment.
Automatic renewal
Your subscription renews automatically at the end of each monthly or yearly period, and we charge the payment method on file at the start of each new period, at the price then in effect, until you cancel. You agree to this when you subscribe, by checking the box on the checkout page.
Free trials
- When we offer a free trial, its length is shown before you subscribe. Each club can have one free trial, ever.
- You need to enter a payment method to start a trial. You are not charged during the trial.
- Your first charge happens on the day the trial ends, on the date shown at checkout, unless you cancel before then. After that, the subscription renews automatically as described above.
- If you cancel during the trial, you are never charged, and the club stays published until the trial ends.
Emails we send
We email the club owner and the billing email on the Stripe account:
- Purchase confirmation: right after you subscribe, with the price, how often it renews, the date of the first or next charge, and how to cancel.
- Trial ending reminder: about 3 days before a free trial ends, with the date and amount of the first charge and how to cancel.
- Yearly renewal reminder: for yearly plans, about 30 days before each renewal, with the renewal date, the amount, and how to cancel.
- Cancellation confirmation: when you cancel, with the date the club stops being published.
- Subscription ended: when the subscription actually ends.
- Price change notice: when we announce a new price, at least 30 days ahead, and again 7 to 30 days before your first charge at the new price.
Monthly plans do not get a separate reminder before each renewal.
How to cancel
You can cancel anytime, online. Open your club's Billing tab and choose Cancel subscription, or use the Stripe customer portal linked from the same tab. It takes a couple of clicks. You never need to call us, chat with anyone, or accept an offer to cancel. You can also email support@pushup.cc and we will cancel for you.
What happens when you cancel
- Canceling stops all future charges.
- The club stays published until the end of the period you already paid for (or the end of your trial). After that it goes back to being a draft.
- A draft club keeps its members, history and leaderboard. New people cannot join until you publish again.
- If you delete the club or your account, the subscription is canceled at once and the club is deleted.
- If a payment fails, Stripe will retry it. If it still cannot be collected, the club goes back to being a draft.
Refunds
Changed your mind? Email support@pushup.cc within 7 days of any charge and we will refund that charge in full, no questions asked. After 7 days, payments are not refundable, including for the unused part of a period, except where the law requires a refund. If we charged you by mistake, or charged you after you canceled, email us at any time and we will refund it. If we close your club or discontinue pushup.cc without the club having broken these terms, we will refund the unused part of your current period.
Price changes
We may change subscription prices. We will email you at least 30 days before a new price takes effect, and it applies from your first renewal on or after that date. We will email you again 7 to 30 days before your first charge at the new price, with the new amount and how to cancel. If you do not want to pay the new price, cancel before that renewal.
Free publishing
We may publish a club for free at our discretion (for example, for a pilot). If we end free publishing, we will tell the owner first, and the club returns to being a draft unless the owner subscribes.
Not medical advice
pushup.cc is a fitness tracker, not a health care provider. Nothing in the app, including goals, stats, projections and games, is medical advice. Talk to a doctor before you start or change an exercise routine, especially if you have a health condition, an injury, or are pregnant. Stop and get help if you feel pain, dizziness or shortness of breath. Injured Reserve is a label you choose to show others; it is not a medical assessment.
Exercise carries a risk of injury. You decide what you do, how much and how often, and you take on that risk. Goals, streaks, leaderboards, challenges from friends and games can push you to do more. Do not let them push you past what is safe for you, and do not log or chase reps through pain.
Copyright
We respect copyright and expect you to. If you think content on pushup.cc infringes your copyright, follow our Copyright and DMCA Policy. We close the accounts of repeat infringers in appropriate circumstances.
Changes to the service
We keep improving pushup.cc, so features may be added, changed or removed. Some features may be marked as beta and may not work perfectly. We may suspend or stop the service, with reasonable notice where we can give it. If we stop the service for good, we will give you a way to download your data first.
Ending your account
- You can leave anytime: delete your account in Settings. It is permanent and erases your data as described in the Privacy Policy.
- We can suspend or close accounts: that break these terms, create risk or legal exposure for us or others, or have been used to abuse the service. We will tell you why unless the law or safety prevents it, and you can appeal as described above.
- What survives: the sections on your content license (for backups), refunds we owe you, disclaimers, limitation of liability, indemnity, governing law and general terms continue after your account ends.
Disclaimers
pushup.cc is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the service will be uninterrupted, error-free or secure, that stats or leaderboards will be accurate (they rely on what users log), or that data will never be lost.
Names, photos, club pages and logged sets come from users, not from us. We do not check them before they appear, and we are not responsible for them, though we act on reports as described above.
Limitation of liability
To the fullest extent the law allows, Nova Hawk Labs LLC and its members, managers and staff are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost goodwill, arising from your use of pushup.cc, even if we were told they were possible. Our total liability for any claim about pushup.cc is limited to the greater of the amount you paid us in the 12 months before the claim or US$50.
Some places do not allow these exclusions or limits, so they may not fully apply to you. Nothing in these terms limits liability that cannot be limited by law, such as for fraud, or for death or personal injury caused by negligence where that is the rule, or takes away rights you have as a consumer.
Indemnity
To the extent the law allows, you agree to cover our reasonable costs, including legal fees, from third-party claims arising from content you post or your breach of these terms. This does not apply to claims caused by our own fault.
Governing law and disputes
These terms are governed by the laws of the State of Texas, USA, and applicable US federal law, without regard to conflict of laws rules.
- Talk to us first: before either of us files a claim, the one with the complaint emails the other (we use the email on your account; you use support@pushup.cc) and describes it. We both try in good faith to settle it for 30 days.
- Courts: if it is not settled, it will be decided by the state or federal courts located in Travis County, Texas, and you and we agree to their jurisdiction. Either of us may instead bring an individual claim in a small claims court where it qualifies.
- Your local consumer law: nothing in these terms takes away a protection that the consumer laws of the place where you live give you and that a contract cannot waive. Those rights still apply where the law requires it.
General terms
- Entire agreement: these terms, with the policies they link to, are the whole agreement between you and us about pushup.cc.
- Severability: if a court finds part of these terms unenforceable, the rest stays in effect.
- No waiver: if we do not enforce a term right away, we can still enforce it later.
- Assignment: you cannot transfer these terms to someone else. We can transfer them as part of a merger, acquisition or sale of assets.
- Export rules: you must follow US export and sanctions laws when you use pushup.cc.
- Other services: Sign in with Google and Stripe checkout are run by those companies under their own terms. We are not responsible for them.
- Events outside our control: we are not responsible for a delay or failure caused by something we cannot reasonably control, such as an outage at one of our providers, a network failure or a natural disaster.
- Notices: we may send notices to the email on your account or show them in the app. You agree to receive agreements, notices and other communications from us electronically, and that they count as being in writing. You can send notices to the contact details below.
Changes to these terms
We will update the "Last updated" date whenever these terms change. For a material change, we will tell you in the app and by email at least 30 days before it takes effect, unless the change is required by law or needed to fix a security or safety problem. If you keep using pushup.cc after a change takes effect, the new terms apply. If you do not agree, you can delete your account, and you can cancel a club subscription before its next renewal.
