Copyright and DMCA Policy

People can upload profile photos and club logos and choose names on pushup.cc. We respect copyright and respond to clear notices of infringement under the US Digital Millennium Copyright Act (DMCA). This policy is part of our Terms of Service.

Reporting infringement

If you believe content on pushup.cc infringes your copyright, send a written notice that includes:

  1. Your physical or electronic signature (typing your full name works for email).
  2. A description of the copyrighted work you believe was infringed.
  3. Where the material is on pushup.cc, specific enough for us to find it (for example, the username or the club page address, and whether it is the photo, logo or name).
  4. Your name, mailing address, phone number and email address.
  5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.

When we receive a complete notice, we will remove or disable the material promptly and tell the person who posted it. We may give them a copy of your notice, including your name and contact details, so they can respond.

Counter-notice

If your content was removed and you believe that was a mistake or that you have the right to use it, send our designated agent a counter-notice that includes:

  1. Your physical or electronic signature.
  2. A description of the material that was removed and where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of a mistake or misidentification.
  4. Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice or their agent.

We will send your counter-notice to the person who filed the original notice. Unless they tell us within 10 business days that they have filed a court action to stop the infringement, we will restore the material within 10 to 14 business days after we receive your counter-notice.

Repeat infringers

We close the accounts of users who repeatedly infringe copyright, in appropriate circumstances.

False claims

Under 17 U.S.C. 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages. If you are not sure whether something infringes your rights, consider talking to a lawyer first.

Trademarks and impersonation

If a club name, logo or profile misuses your trademark or pretends to be your organization, email support@pushup.cc with details. These reports are handled under our Community Guidelines, not the DMCA process.
